Terms of Service

1. Eligibility

You must be at least 15 years old to use the App. By using the Service, you represent that you meet this age requirement. If you are under the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Description of the Service

Arcticalm is a wellness application that provides guided breathing exercises, meditation sessions, and hot/cold exposure tracking tools. The Service is intended for general wellness and relaxation purposes only.

The App requires a subscription to use. A 7-day free trial is offered to new users, after which continued access requires an active monthly or yearly subscription managed via the Apple App Store or Google Play Store.

3. Medical Disclaimer

The App does not provide medical advice, diagnosis, or treatment. All content — including breathing exercises, meditation techniques, and cold/hot exposure guidance — is provided for general informational and wellness purposes only.

Cold water immersion, breathwork (including breath-holding exercises), and sauna use carry inherent risks, including but not limited to drowning, loss of consciousness, cardiovascular stress, and hypothermia. You acknowledge these risks and accept full responsibility for your safety.

Always consult a qualified healthcare professional before starting any new wellness practice, particularly if you have a medical condition, are pregnant, or take prescription medication. Never practice breath-holding exercises in or near water without appropriate supervision.

We are not liable for any injury, health complication, or other harm arising from your use of the Service.

4. Account and Access

Arcticalm does not require you to create an account. Your session data is stored locally on your device. You are responsible for the security of your device and for any activity that occurs through the App on your device.

5. Subscriptions and Payments

Subscriptions are processed and managed by Apple App Store or Google Play Store. By starting a trial or purchasing a subscription, you also agree to their respective terms of service and payment policies.

• New users receive a 7-day free trial. Your subscription begins at the end of the trial period unless you cancel before it expires.
• Subscriptions are available on a monthly or yearly basis and automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date.
• You may manage or cancel your subscription at any time through your App Store or Google Play account settings.
• Refunds are subject to Apple's or Google's refund policies, not ours.
• Prices may change; you will be notified before any price change takes effect.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Reverse-engineer, decompile, or disassemble any part of the App
• Attempt to gain unauthorized access to the Service or its related systems
• Remove, alter, or obscure any copyright, trademark, or other proprietary notice
• Use the Service in any way that could damage, disable, or impair its proper functioning
• Redistribute or resell the App or any of its content

7. Intellectual Property

All content in the App and on the website — including but not limited to text, graphics, audio, animations, logos, and software — is owned by Arcticalm or its licensors and is protected by applicable intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial wellness purposes, subject to these Terms.

Audio recordings you create within the Affirmation Meditation feature remain yours. We have no claim to that content.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Arcticalm and its operators, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including physical injury, loss of data, or loss of revenue — arising out of or related to your use of, or inability to use, the Service.

Our total aggregate liability to you for any claims arising under these Terms shall not exceed the amount you paid to us (if any) in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Arcticalm and its operators from any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your violation of these Terms or misuse of the Service.

12. Changes to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part of it) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page and, where appropriate, posting a notice in the App. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of competent jurisdiction.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
